1. Acceptance of Terms

By accessing or using the Elevated Eats website, mobile applications, or any related services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

Elevated Eats LLC (“we,” “us,” or “our”) reserves the right to update or modify these Terms at any time. We will notify you of material changes by updating the “Last updated” date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Description of Service

Elevated Eats is a meal prep ordering platform that allows customers to browse weekly menus, place orders for prepared meals, and arrange for delivery or pickup in the Massachusetts area. We prepare fresh, wholesome meals and make them available on a weekly rotating menu.

3. Account Registration

  • You must create an account to place orders. You may register with an email and password or through Google Sign-In.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate, current, and complete information during registration.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years of age to create an account and use the Service.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Orders and Payments

4.1 Placing Orders

  • All orders are subject to availability and confirmation.
  • Menu items, prices, and availability may change weekly without prior notice.
  • We reserve the right to refuse or cancel any order for any reason, including errors in pricing or availability.
  • Order deadlines are posted on the website. Orders placed after the deadline may not be fulfilled for the current week.

4.2 Pricing and Taxes

  • All prices are listed in US Dollars and are subject to applicable state and local taxes.
  • Tax amounts are calculated at checkout based on your delivery or pickup location.
  • We reserve the right to correct pricing errors at any time.

4.3 Payment Methods

  • We accept credit cards, debit cards, bank account payments (via Stripe), and Venmo where available.
  • Payment is processed at the time of order for card/bank payments.
  • For Venmo orders, payment must be completed promptly after placing the order.

4.4 Refunds and Cancellations

  • Refund requests must be made by contacting us at [email protected].
  • Orders cancelled before the weekly preparation deadline may be eligible for a full refund.
  • Orders cancelled after preparation has begun may be eligible for partial refunds at our discretion.
  • Refunds for card/bank payments will be processed back to the original payment method.

5. Delivery and Pickup

  • Delivery is available to select zip codes within our service area. Delivery fees vary by zone.
  • We will make reasonable efforts to deliver within the scheduled window, but delivery times are estimates and not guaranteed.
  • You are responsible for providing accurate delivery information. We are not liable for failed deliveries due to incorrect addresses.
  • Pickup orders must be collected during the designated pickup window at the selected location.
  • Unclaimed pickup orders may be forfeited without refund after the pickup window closes.

6. Loyalty Program and Promotions

  • Our loyalty rewards program awards points on qualifying purchases. Points can be redeemed for discounts on future orders.
  • Loyalty points have no cash value and cannot be transferred or exchanged.
  • We reserve the right to modify, suspend, or terminate the loyalty program at any time.
  • Coupon codes and gift cards are subject to their own terms and conditions, including expiration dates and usage limits.
  • Promotions cannot be combined unless explicitly stated.

7. Allergens and Dietary Information

  • We provide ingredient and allergen information to the best of our ability. However, our kitchen handles common allergens including nuts, dairy, gluten, soy, eggs, and shellfish.
  • We cannot guarantee that any menu item is completely free of allergens due to potential cross-contamination.
  • If you have severe food allergies, please contact us directly before ordering.
  • You assume all risk associated with food allergies when placing an order.

8. Intellectual Property

All content on the Service — including text, images, logos, recipes, graphics, and software — is the property of Elevated Eats LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our written permission.

9. Prohibited Conduct

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Submit false or misleading information
  • Use automated tools (bots, scrapers) to access the Service
  • Resell or commercially exploit any part of the Service without permission

10. Limitation of Liability

To the maximum extent permitted by law, Elevated Eats LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Indemnification

You agree to indemnify, defend, and hold harmless Elevated Eats LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Massachusetts.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
